This document provides information on the processing of personal data by Technické služby Adršpach, s.r.o., with the company registration number 252 99 115, registered at Horní Adršpach 128, 549 52 Adršpach, listed in the Commercial Register maintained by the Regional Court in Hradec Králové, under the file number C 14110 (hereinafter referred to as the "Company"), in connection with the use of the website at www.adrspasskeskaly.cz/online-vstupenky (hereinafter referred to as the "Website").


I. Basic terms

1.1    In the introduction, we would like to inform you about some basic terms used in this information and which are also defined in the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 94/46/EC ("GDPR").

1.2    "Personal data" means any information relating to an identified or identifiable natural person. This includes a person who can be directly or indirectly identified by reference to a particular identifier (such as name, ID number, location data, or network identifier).

1.3    "Data subject" is the individual person whose personal data is being processed in a particular case.

1.4    "Processing" means any operation or set of operations performed on personal data (such as recording, organizing, storing, etc.).

1.5    "Controller" is the person who determines the purposes and means of processing personal data.

1.6    "Processor" is the person who processes personal data on behalf of the controller.

1.7    "Recipient" is the person to whom the personal data has been provided.

1.8    "Consent" of the data subject means any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of his or her personal data.


II.    Purposes and legal basis for processing personal data

2.1    We process your personal data for the following purposes and on the following legal bases:

    1. for the purpose of fulfilling contractual obligations that the Company concludes with you (a contract concluded based on your order on the Website);

    2. for the purpose of maintaining a database of our customers based on the legitimate interest of the Company in maintaining this database;

    3. for the purpose of fulfilling legal obligations arising from legal regulations (keeping accounts, etc.);

    4. for the purpose of enforcing the Company's legal claims based on the legitimate interest of the Company in protecting their rights; in the event that you give us your consent (by subscribing through a link sent to you along with your order),

    5. for the purpose of sending commercial messages promoting the Company and/or goods or services of the Company (such as promotional offers, information about events, or similar messages) in an irregular newsletter.

2.2    In the case of processing personal data for the purpose of fulfilling contractual obligations and based on a contract, the provision of your identification and contact information is necessary for concluding and fulfilling the contract.

2.3    The Company usually obtains personal data directly from the data subject, i.e., from you.

IV.    Categories of the personal data

4.1    For the purposes specified in Article 2, the Company processes in particular the following data:

    1.    identification data (name, surname, identification number, etc.);

    2.    contact details (delivery address, email address, telephone number, etc.);

    3.    other data necessary for the performance of the contract (such as payment method, delivery method, quantity and type of ordered goods, etc.);

    4.    any additional data to which the data subject has given consent.


V. Processing period

5.1    Your data will be processed:

    1.    for the purpose of fulfilling the contract for the duration of this contract;

    2.    for the purpose of maintaining the customer contact database of the Company for a period of 2 years from your last order;

    3.    for the purpose of fulfilling legal obligations for the duration required by the relevant legal regulation that imposes such obligation on the Company;

    4.    for the purpose of defending legal claims of the Company for at least one year from the expiry of the limitation period for such claims;

    5.    for the purpose of sending commercial messages in irregular newsletters for a period of 2 years from the granting of consent to receive the newsletter, and in case you revoke the consent before the expiration of this period, then for the duration until it is revoked; however, always for a period during which these data may be processed in accordance with applicable and effective legal regulations.



VI. Recipients and processors of personal data

6.1    The personal data you provide may be further disclosed/made accessible to other recipients. This may include, for example, the contractual partners of the Company (carriers, providers of IT services, tax, legal or other services providers) as well as public authorities (authorities, courts, law enforcement agencies) and others.


VII. Cookies

7.1   When you visit the Website, we automatically process so-called cookies about you. Cookies are small text files that websites store in your browser. Cookies allow websites to function properly and record information about a customer's visit (such as settings, preferred language, etc.).

7.2     What are the types of cookies?

basic (technical) cookies – these cookies ensure the proper functioning of the website and during the visit of the website they help to display it properly. Without them, the website would not function properly or its functionality would be limited;

functional cookies – these cookies allow the website to remember your choices or the current state of the pages (such as language choice or other preferences), thereby improving the functionality of the pages. These cookies can also remember changes in font size, font type, and other parts of the web pages, as customized by the user. Information collected through these cookies does not track your activities when visiting other websites. In order to recognize a repeated visit to the website and display the web pages as set by the user, they cannot be deleted after the session ends (when the browser is closed), but remain stored on the device.

operational (analytical) cookies – information gathered through these cookies is primarily used to better understand how the website is being used and to optimize the website. With these cookies, it is possible to determine which parts of the website the user clicked on, which content was displayed, and the number of visits.

7.6    The collected cookie files may be processed by other processors, especially by persons providing IT services to the Company. The Company uses the Google Analytics and Facebook pixel services in connection with the Websites. VIII. Data subject rights

8.1    The company processes personal data relating to data subjects in a correct and lawful, transparent manner. Data is collected for specific, explicit and legitimate purposes. The company ensures that personal data is accurate and updated when necessary. The company takes all reasonable steps to promptly delete or correct personal data that is inaccurate with regard to the purposes for which it is processed.

8.2    The company values the protection of data subject rights and proper security of personal data, therefore when processing personal data, it ensures through appropriate technical or other measures the highest possible level of security corresponding to the possible risks of the relevant processing.

8.3    The data subject may request information and access to personal data in accordance with Articles 13 and 14 of the GDPR, in particular, the right to request:

  • the identity and specific details of the data controller,
  • information on the purposes for which personal data is intended,
  • access to personal data,
  • correction, deletion or limitation of the processing of personal data,
  • termination of the processing of personal data.

8.4    The data subject may further object to the processing. If the processing is based on consent (Art. 6(1)(a) or Art. 9(2)(a) GDPR), the data subject has the right to withdraw consent to the processing of personal data, without affecting the lawfulness of processing based on consent before its withdrawal.

8.5    If you have given consent to the Company to process your personal data, you can withdraw this consent at any time, completely free of charge.

8.6    If you believe that your data is being processed by the Company in violation of legal regulations, you can file a complaint with the supervisory authority – the Office for Personal Data Protection. However, in order to achieve the fastest possible resolution, we recommend that you first contact the Company.

8.7    If you have any questions regarding the processing of your personal data, or if you wish to update or correct your personal data, or if you want to request their erasure or restriction of processing, or if you want to object to the processing, please contact the Company through the contacts provided in Art. 3.
